Can't afford an agent? How about jail time?

I got a call recently from a friend who decided that they could not afford a to list their home with a real estate professional due to market conditions in their neighborhood. Very understandable. As a full time REALTOR®, I hear that a lot these days.

They were able to successfully get their home under contract by having open houses and using fliers....and reducing their price to close to their existing loan balance. There are tons of homes marketed in their subdivision. At last check it was almost 28!

Low and behold, they received a phone call asking them to rewrite the contract and date it for a month prior to the actual contract date. Now, I am not an attorney, however, that seems like it would be loan fraud to me. The intention appeared to be so that the buyer could get the first time home buyer tax credits. Ok, now I bet you are talking Federal charges.

So, this is something a reputable lender would NEVER ask you to do. A professional REALTOR® would never suggest that you do this. Loan fraud is arguably one of the scenarios that helped to bring the real estate market to it's knees and is being heavily investigated. The IRS is even posting warnings about this type of activity. But come on, who really wants to visit the IRS website.
